What requirements apply to MOCAs?
Materials and Articles Intended to Come into Contact with Food must comply with Regulation (EC) No. 1935/2004, which stipulates that, under normal or foreseeable conditions of use, they must not migrate substances into food in quantities that could endanger human health, change the food’s composition, or alter its organoleptic characteristics.
Depending on the material, specific regulations may apply, such as Regulation (EU) No. 10/2011 for plastics. In addition, for all MOCA products, the provisions on Good Manufacturing Practices (Regulation (EC) No. 2023/2006) apply.
What laboratory tests are performed on MOCA?
Laboratory testing depends on the type of material (plastic, paper, metal, etc.) and the intended conditions of use. In general, the tests may include:
- Global and Specific Migration Tests
- Analysis of Restricted Substances
- Tests under conditions representative of the intended use
- Technological Suitability of Materials and the Object
- Testing for the presence of unintentionally added substances (NIAS) and dual-use additives
Test results show that the material complies with the applicable limits and is suitable for contact with food under the declared conditions, which simulate actual conditions of use.
How can compliance be ensured in the absence of specific regulations?
In the absence of specific legislation, compliance with Regulation (EC) No. 1935/2004 can be demonstrated through a risk assessment based on the material’s composition, chemical processes, and treatments applied to it. This applies, for example, to textile materials intended to come into contact with food.
Are laboratory tests sufficient to demonstrate compliance?
No. You must prepare a declaration of conformity that includes the applicable regulatory references and the evidence documented in the test reports.
Our team of experts is available to provide technical support in preparing the declaration of conformity.
